TERMS OF SERVICE

By purchasing coaching services, you agree to the following terms and conditions:

 

SERVICE DESCRIPTION

Coaching services include personalized holistic coaching sessions informed by the Gravity Point® methodology. Complimentary 30-minute discovery calls are offered to assess mutual fit prior to paid services. All services are educational and developmental in nature and are not a substitute for medical, psychological, or therapeutic treatment. Professional conduct policies apply to all interactions, including discovery calls.

PAYMENT TERMS

- Single Sessions: $150 per 45-minute session, payment due at time of booking

- Monthly Membership: Payment due monthly in advance for 4 sessions

- All payments are processed securely through Square

- Accepted payment methods: Credit cards, debit cards, and ACH transfers

- Failed payments may result in session cancellation and account suspension

CANCELLATION & REFUND POLICY

- 24-Hour Advance Notice Required: All session cancellations must be made at least 24 hours prior to scheduled time via email

- Late Cancellations: Sessions cancelled with less than 24 hours notice will be forfeited with no refund

- No-Shows: Failure to attend a scheduled session will result in full charge with no refund

- Completed Sessions: No refunds will be provided for any completed coaching sessions regardless of client satisfaction

- Membership Cancellations: Monthly memberships may be cancelled at any time with written notice via email

- No Partial Refunds: No prorated refunds for partial months or unused portions of services

- Final Sale:All payments are final upon completion of services, regardless of outcomes or client satisfaction

- Refund Exceptions: Refunds may be considered only for future, unused sessions in cases of documented medical emergency at sole discretion of coach

SESSION POLICIES

- Punctuality: Clients arriving more than 7 minutes late will have their session cancelled and charged in full

- Rescheduling: One reschedule opportunity may be offered at coach’s discretion for late arrivals

- Session Access: All sessions conducted through designated client portal platform

- Recordings: Sessions may be recorded for client’s benefit; recordings remain property of client for personal use only

CONFIDENTIALITY & PRIVACY

- All session content and client information will be kept strictly confidential

- Information may only be shared with written client consent or as required by law

- Client portal access is password protected and for individual use only

- Please refer to our Privacy Policy for detailed information about data collection and usage

LIABILITY & DISCLAIMERS

- Coaching services are not medical, psychological, or therapeutic treatment and make no health claims

- Client acknowledges sole responsibility for all decisions, actions, outcomes, and consequences resulting from or related to coaching services

- Coach is not liable for any actions taken by client, including but not limited to: decisions made, relationships affected, career changes, financial decisions, health choices, or any life changes of any kind

- Coach assumes no liability for any direct, indirect, incidental, consequential, or punitive damages

- Client releases and holds harmless coach from any claims, damages, or losses of any kind, whether arising from coaching content, client’s interpretation of advice, or client’s subsequent actions

- MAXIMUM LIABILITY LIMIT: Coach’s total liability for any and all claims is strictly limited to $300 per incident, regardless of the nature or amount of damages claimed. No refunds will be provided for completed sessions under any circumstances.

- Client acknowledges coaching involves personal exploration that may bring up emotional responses

- Client agrees to seek appropriate medical/mental health professionals for any concerning symptoms

- Client waives any right to consequential, punitive, or incidental damages

- Coach is not responsible for client’s implementation, results, or any outcomes from coaching relationship

 

PROFESSIONAL CONDUCT

- Both parties agree to maintain respectful, professional communication at all times

- Client must attend sessions sober and in appropriate mental state for coaching

- Sessions must be conducted in private, appropriate settings free from distractions

- No inappropriate, sexual, threatening, or abusive language or behavior will be tolerated

- Only the registered client may attend sessions unless prior written permission is granted

- Coach reserves absolute right to immediately terminate services for inappropriate behavior without refund or notice

- Client communications outside of sessions must be professional and limited to scheduling/business matters

- Recording of sessions by client permitted for personal use only; unauthorized recording or sharing prohibited

- Any violation of professional boundaries will result in immediate termination of all services

INTELLECTUAL PROPERTY

- Gravity Point® methodology and materials remain property of Gravity Point® Institute

- All coaching session content, notes, and proprietary materials remain property of coach

- Client receives limited license for personal use only of materials provided

- Sharing, reproduction, or commercial use of proprietary materials prohibited without written consent

- Client is encouraged to journal and take personal notes for their own development

DISPUTE RESOLUTION 

- Good faith effort to resolve disputes directly encouraged

- Disputes will be resolved through binding arbitration in Utah County, Utah under Utah state law

- Small claims court option available for amounts under jurisdictional limits in Utah County, Utah

- Attorney Fees: If Coach prevails in any legal proceeding, Client agrees to pay Coach’s reasonable attorney fees and costs. If Client prevails, Client’s attorney fees are limited to $500 maximum. 

MEMBERSHIP TERMS (If Applicable) 

- Unused sessions do not roll over to following month and expire

- Membership benefits non-transferable and non-assignable

- Additional sessions available at current single session rates

- Membership may be cancelled at any time via email with final payment due for current month

- No prorated refunds for partial month cancellations

TECHNICAL REQUIREMENTS 

- Client responsible for reliable internet connection and appropriate device

- Technical difficulties on client’s end do not constitute grounds for refund

- Coach will make reasonable effort to accommodate technical issues

MODIFICATION OF TERMS 

- Terms may be updated at any time without notice to clients

- Continued use of services constitutes acceptance of modified terms

- Current terms always available on coach’s website

- Client responsible for reviewing terms periodically

ADDITIONAL PROTECTIONS

- Force Majeure: Coach not liable for delays/cancellations due to illness, emergencies, natural disasters, or circumstances beyond reasonable control

- Severability: If any provision is deemed unenforceable, remainder of agreement remains in full effect

- No Waiver: Failure to enforce any provision does not constitute waiver of future enforcement

- Entire Agreement: This agreement supersedes all prior agreements and may only be modified in writing

- Age Verification: Client represents and warrants they are 18+ years old. Client assumes full responsibility for accuracy of all information provided, including age verification. Coach relies on client’s representations and is not liable for any false information provided by client. 

ACKNOWLEDGMENT

By completing this purchase, you acknowledge that you:

- Have read, understood, and agree to be bound by these terms and conditions

- Are 18 years or older and have legal authority to enter into this agreement

- Take full responsibility for the accuracy of all information provided, including age verification

- Understand that coaching is not therapy, medical treatment, or mental health services

- Accept full responsibility for your participation, decisions, actions, and any outcomes

- Agree to the cancellation, refund, and conduct policies without exception

- Consent to email communication for business purposes AND marketing communications

- Understand that payment constitutes acceptance of these terms

- Release coach from any liability arising from false or inaccurate information provided

- Acknowledge that you are solely responsible for all consequences of your actions and decisions, whether or not related to coaching sessions

 

Electronic acceptance through purchase serves as legal signature and sworn statement of accuracy

This agreement constitutes the entire agreement between parties and supersedes all prior negotiations, representations, or agreements relating to these services.
